Probate Process in Puerto Rico

The probate process is significantly different than all other states in the United States and for this reason alone is somewhat complicated, especially for clients who are accustomed to the laws that apply in Florida and the rest of the U.S. For example, Puerto Rico law believes in forced heirs and therefore protects the rights of forced heirs despite the existence of a will or another estate planning document. If an individual writes a will and intentionally excludes his or her forced heirs, the will may be considered invalid and unenforceable. Additionally, if you die without a will or if you execute a will incorrectly, you have no control over the distribution of your assets and the government divides your assets according to Puerto Rican law.
